1. Acceptance of Terms

Welcome to Habibi Swipe ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Habibi Swipe mobile application (the "App") and related services (collectively, the "Service").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

Age Requirement:

  • You must be at least 18 years old to use Habibi Swipe
  • By using the Service, you represent and warrant that you are 18 years of age or older

Account Requirements:

  • You must provide accurate, current, and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

Prohibited Users:

  • You may not use the Service if you have been previously banned or removed from Habibi Swipe
  • You may not use the Service if you are prohibited from doing so under applicable laws

3. Description of Service

Habibi Swipe is a free dating and social networking mobile application that allows users to:

  • Create profiles with photos and personal information
  • Discover and connect with other users
  • Send and receive messages with matched users
  • Send compliments to other users

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. User Accounts

Account Creation:

  • You must create an account to use most features of the Service
  • You may sign up using your email address, Apple account, or Google account
  • You must verify your email address to complete registration

Account Security:

  • You are responsible for maintaining the security of your account
  • You must not share your account credentials with others
  • You must notify us immediately if you suspect unauthorized access

Account Termination:

  • You may delete your account at any time through the App settings
  • We reserve the right to suspend or terminate your account for violations of these Terms
  • Upon termination, your right to use the Service will immediately cease

5. User Conduct and Prohibited Activities

You agree NOT to:

Illegal Activities:

  • Use the Service for any illegal purpose or in violation of any laws
  • Engage in fraud, deception, or misrepresentation
  • Impersonate any person or entity

Harmful Content:

Post, upload, or transmit any content that is:

  • Defamatory, harassing, abusive, or threatening
  • Obscene, pornographic, or sexually explicit
  • Discriminatory or hateful based on race, religion, gender, sexual orientation, or other protected characteristics
  • Violent or promotes violence
  • Infringes on intellectual property rights
  • Contains viruses, malware, or other harmful code

Harassment and Abuse:

  • Harass, bully, or intimidate other users
  • Send unsolicited messages or spam
  • Engage in stalking or unwanted contact
  • Share other users' personal information without consent

Commercial Activities:

  • Use the Service for commercial purposes without authorization
  • Solicit money or goods from other users
  • Promote or advertise products or services
  • Use the Service to recruit for multi-level marketing or similar schemes

System Interference:

  • Attempt to hack, breach, or circumvent security measures
  • Use automated systems (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code

False Information:

  • Provide false, misleading, or inaccurate information
  • Create fake profiles or impersonate others
  • Misrepresent your age, identity, or personal information

6. User Content

Your Content:

  • You retain ownership of content you post, upload, or transmit through the Service
  • By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating the Service

Content Standards:

  • You are solely responsible for all content you post
  • Content must comply with these Terms and applicable laws
  • We reserve the right to remove any content that violates these Terms

Content Moderation:

  • We may review, edit, or remove content at our discretion
  • We are not obligated to monitor all content but reserve the right to do so
  • We may use automated systems to detect and remove prohibited content

Reporting Content:

  • Users can report inappropriate content or behavior through the App
  • We will investigate reports and take appropriate action

7. Intellectual Property

Our Rights:

  • The Service, including all content, features, and functionality, is owned by Habibi Swipe
  • All trademarks, logos, and brand names are our property
  • The App and its original content are protected by copyright, trademark, and other intellectual property laws

Your Rights:

  • You retain ownership of content you create and post
  • You grant us a license to use your content as described in Section 6

Limited License:

  • We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
  • You may not copy, modify, distribute, or create derivative works of the App

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

Service Availability:

  • The Service is provided "as is" and "as available"
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • We are not responsible for any downtime, outages, or technical issues

No Warranties:

  • We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We do not warrant that the Service will meet your requirements or expectations

User Interactions:

  • We are not responsible for the conduct of any user
  • We do not verify the accuracy of user-provided information
  • You are solely responsible for your interactions with other users
  • We recommend exercising caution when meeting people in person

10. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss or damage resulting from:
    • Your use or inability to use the Service
    • Unauthorized access to or use of your account
    • Any conduct or content of third parties
    • Any interactions between users

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Habibi Swipe, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another user or third party
  • Any content you post or transmit

12. Termination

By You:

  • You may delete your account and stop using the Service at any time

By Us:

  • We may suspend or terminate your access to the Service at any time, with or without cause or notice
  • We may terminate your account for violations of these Terms
  • Upon termination, your right to use the Service will immediately cease

Effect of Termination:

  • Upon termination, we may delete your account and associated data
  • Some information may be retained as required by law or for legitimate business purposes

13. Dispute Resolution

Governing Law:

  • These Terms shall be governed by the laws of State of Texas, without regard to conflict of law principles

Dispute Resolution:

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Good faith negotiation
  2. If negotiation fails, through binding arbitration in accordance with applicable arbitration rules
  3. Class action waivers apply

Jurisdiction:

  • You agree that Governing law shall be Texas, unless prohibited by local consumer protection laws.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you a notification (for material changes)

Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Miscellaneous

Entire Agreement:

  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habibi Swipe

Severability:

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect

Waiver:

  • Our failure to enforce any right or provision of these Terms shall not constitute a waiver

Assignment:

  • You may not assign or transfer these Terms or your account without our consent
  • We may assign these Terms without restriction
